			<content:encoded><![CDATA[<p>The Rocky Mountain Natural Meats<em> E. coli</em> recall has grown to include another 776 pounds of  potentially contaminated buffalo cuts that were distributed to a firm in Nevada for further processing.</p>
<p>The recall revision adds various weight boxes of Rocky Mountain Natural Meats  &#8220;BISON B TRIM&#8221; to the pre-existing recall notice for 66,000 pounds of ground buffalo and buffalo steaks and medallions. The B Trim boxes bear a production date of May 21, 2010 and a Julian Code of 14110. The boxes also state &#8220;KEEP REFRIGERATED.&#8221;<a href="http://www.ecolilawyer.com/wp-content/uploads/2010/07/natures-rancher-E-coli-law3.jpg"><img class="alignright size-full wp-image-1580" title="nature's-rancher-E-coli-law" src="http://www.ecolilawyer.com/wp-content/uploads/2010/07/natures-rancher-E-coli-law3.jpg" alt="" width="290" height="277" /></a></p>
<p>The new notice from USDA&#8217;s Food Safety and Inspection Service (FSIS) doesn&#8217;t contain new information about the <a href="http://www.pritzkerlaw.com/ecoli/rocky-mountain-natural-meats-lawsuit.html">ground buffalo<em> E. coli</em> outbreak</a> previously announced last Friday. So far there have been five people in Colorado and one in New York sickened by the same strain of <a href="http://www.pritzkerlaw.com/escherichia-coli-O157/"><em>E. coli</em> O157:H7</a>, a potentially deadly bacterium that is banned in ground beef.</p>
<p>FSIS associated the Colorado outbreak with ground buffalo recalled by Rocky Mountain Natural Meats of Henderson, Colo. The individual brands are <a href="http://www.pritzkerlaw.com/ecoli/great-range-bison-ecoli-lawsuit.html">Great Range Ground Bison</a>, <a href="http://www.pritzkerlaw.com/ecoli/natures-rancher-ground-buffalo-ecoli.html">Nature&#8217;s Rancher Ground Buffalo </a>and The Buffalo Guys Ground Buffalo 90 Percent Lean. They are sold nationwide at grocery stores and in some restaurants via distributors in Arizona and Utah.</p>
<p><strong>Because consumers often freeze retail meat purchases</strong>, officials fear there is a potential for the outbreak to grow indefinitely. Freezing temps don&#8217;t kill the pathogen. If you have eaten buffalo meat and fallen ill with painful diarrhea, including bloody diarrhea, contact your physician immediately and request a stool culture.</p>

The <a href="http://www.fda.gov/Safety/Recalls/ucm211131.htm" target="_blank">recall</a> comes after FDA informed Freshway Foods the afternoon of Wednesday, May 5 that a previously unopened product sample in a New York state laboratory tested positive for the bacteria.</p>
<p>The recalled Freshway Foods romaine lettuce products were sold under the Freshway brand and Imperial Sysco brand to food service outlets (including university campus food service), restaurants and in-store retail salad bars and delis in the following states:</p>
<blockquote><p>Alabama, Connecticut, District of Columbia, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Virginia, West Virginia, and Wisconsin.</p></blockquote>
<p>The recalled romaine products were also sold for distribution to in-store salad bars and delis for Kroger, Giant Eagle, Ingles Markets, and Marsh stores in the states listed above. Consumers who purchased romaine from an in-store salad bars and delis at Kroger, Giant Eagle, Ingles Markets, and Marsh stores in the states previously listed should throw the product away UNLESS SOMEONE ATE SOME OF THE LETTUCE AND MAY CONTRACT OR HAS CONTRACTED AN E COLI O145 INFECTION.  If someone has been diagnosed with an E coli infection, you should contact our law firm regarding testing the leftovers for E. coli.</p>

			<content:encoded><![CDATA[<p>The USDA&#8217;s<a href="http://www.fsis.usda.gov/"> Food Safety and Inspection Service</a> (FSIS) officially amended its regulations on August 18, 2008, to require publication of the names and locations of all retailers receiving meat or poultry subject to Class I product recalls &#8212; those deemed to be high risk to human health.</p>
<p>The change has delivered critical new information to consumers during outbreaks of <a href="http://www.pritzkerlaw.com/ecoli/"><em>E. coli</em> O157:H7</a>,<a href="http://www.pritzkerlaw.com//salmonella/"> </a><em><a href="http://www.pritzkerlaw.com//salmonella/">Salmonella</a>, <a href="http://www.pritzkerlaw.com//listeria/">Listeria</a>, <a href="http://www.pritzkerlaw.com//campylobacter/">Campylobacter</a></em> and other foodborne diseases that annually kill about 5,000 people in the U.S., including those who die from <a href="http://www.pritzkerlaw.com/ecoli-hus/">HUS E coli.</a><a href="http://www.ecolilawyer.com/wp-content/uploads/2010/01/Applebees-E-coli-class-acti.jpg"><img class="alignright size-full wp-image-1103" title="Applebees-E-coli-class-acti" src="http://www.ecolilawyer.com/wp-content/uploads/2010/01/Applebees-E-coli-class-acti.jpg" alt="" width="280" height="186" /></a></p>
<p>But FSIS excluded restaurants from the new requirement and national food safety law firm<a href="http://www.pritzkerlaw.com/food-litigation/"> Pritzker Olsen</a> has learned that the decision was made despite criticism from state and local health officials and other food safety advocates.</p>
<p>According to the <a href="http://www.gpoaccess.gov/fr/">Federal Register</a>, FSIS received several comments during the rule-making process that said the disclosure effort didn&#8217;t go far enough.  Excluding restaurants, hotels, cafeterias and other outlets &#8220;will create an unnecessary hurdle for state or local public health agencies to overcome to obtain timely distribution information&#8221; during an outbreak,  the document summarized.</p>
<blockquote><p><strong>&#8220;One commenter stated that providing (restaurant) information would provide consumers greater protection from the risks associated with tainted meat or poultry while another suggested that restaurants be included so that individuals are fully aware of the scope of recalls.&#8221;</strong></p></blockquote>
<p>But agency officials rejected the urgings, saying restaurant disclosure was beyond the scope of the new rule: Which was intended to help consumers determine if they have tainted meat in their homes.</p>
<p>In the wake of the National Steak and Poultry E. coli recall of 248,000 pounds of beef products sold to restaurants nationwide, the FSIS may want to reconsider.  The December 24 recall was Class I, meaning that there was a reasonable probability that the use of the product would cause serious adverse health consequences or death.</p>
<p>Yet the FSIS&#8217;s recall announcement, issued with input from the company, included only a partial list of restaurants that received the product. Many days later, media scrutiny revealed that the FSIS announcement was incomplete and misleading. Two giant restaurant chains &#8212; Applebees and Olive Garden &#8212; also had received beef products involved in the recall.</p>
<blockquote><p><strong>If the point of  government recalls is to protect consumers, it makes no sense to impede them from accurately identifying where tainted products are being sold. Just as it is with meat and poultry recalled from grocery stores, the information is readily available from the manufacturer and does not constitute confidential commercial information.</strong></p></blockquote>

<p>On December 24th, the Oklahoma meat processor recalled 248,000 pounds of beef products after federal and state officials determined there was an “association” between  blade tenderized steaks and<a href="http://www.pritzkerlaw.com/escherichia-coli-O157/"> <em>E. coli</em> O157:H7</a> illnesses in six states.</p>
<p><a href="http://www.usda.gov/"><img class="alignleft size-full wp-image-1067" title="National-Steak-and-Poultry-" src="http://www.ecolilawyer.com/wp-content/uploads/2009/12/National-Steak-and-Poultry-2.jpg" alt="National-Steak-and-Poultry-" width="280" height="186" />USDA</a> said the recalled meat was sold to restaurants &#8220;nationwide,&#8221; but not a single restaurant was named.</p>
<p>On Monday National Steak and Poultry said in a press release that the meat was sold primarily to Moe&#8217;s Southwest Grill, Carino&#8217;s Italian Grill and KRM restaurant locations in Michigan, Colorado, South Dakota, Iowa, Kansas and Washington &#8212; the same states where the corresponding outbreak is located. At  least 19 people are said to be sickened by the potentialy deadly bacteria.</p>
<p>Unless we&#8217;re missing something, six states in the greater Midwest and Northwest does not constitute &#8220;nationwide&#8221; distribution. And why hasn&#8217;t USDA published a comprehensive listing of all the retail outlets where the recalled meat was sold? Such disclosure is customary in Class I High Health Risk situations.</p>
<p>As <a href="http://www.pritzkerlaw.com/food-litigation/">Pritzker Olsen Attorneys</a> and other food safety organizations have stated previously, announcing a recall without thoroughly and promptly identifying the public purveyors of the adulterated product is ludicrous and unsafe. It’s the equivalent of announcing a recall of flammable pajamas without identifying the retailers who sold them.</p>
<p>Consumers cannot protect themselves if they have no information about unsafe products that threaten them. This is a failure of  regulation and a violation of food ethics and it raises questions about whether our food safety agencies are more interested in protecting producers of dangerous products or in safeguarding the public’s health.<img class="alignright size-full wp-image-1069" title="E-coli-Lawyer" src="http://www.ecolilawyer.com/wp-content/uploads/2009/12/E-coli-Lawyer.jpg" alt="E-coli-Lawyer" width="270" height="195" /></p>
<p>The discrepancies in this National Steak and Poultry E. coli recall are enough to make you wonder if tons of similar products may have been shipped to even larger restaurant chains than Moe&#8217;s, Carino&#8217;s and KRM. NSP counts as its customers &#8220;some of America’s best known chains.” What about those chains?</p>
<p>Let’s hope the implicated product is limited to the first three companies. But if it comes out later that other restaurant companies purchased adulterated product from NSP, both the companies and the government agencies charged with food safety will have a great deal to explain and justify.</p>

<p>Under federal law, ground beef contaminated with <em>E. coli</em> O157:H7 is “adulterated” for civil tort purposes, and you and your child may have the right to sue Fairbank Farms and possibly Shaw’s for medical expenses, lost earnings, pain and suffering, emotional distress and other damages.</p>

			<content:encoded><![CDATA[<p>The Massachusetts Department of Public Health (DPH) has been working with the United States Department of Agriculture (USDA), the Centers for Disease Control and Prevention (CDC) and other New England state health departments to identify persons infected with <em>E.coli</em>:O157:H7 who may have consumed undercooked ground beef contaminated with the same strain of the disease causing organism.</p>
<p><img class="alignright size-full wp-image-828" title="Hamburger E. coli" src="http://www.ecolilawyer.com/wp-content/uploads/2009/10/hamburger-patties.jpg" alt="Hamburger E. coli" width="123" height="110" />Health officials have found a <a href="http://www.pritzkerlaw.com/section-foodborne-illness/food-safety-lawyer/PFGE.html" target="_self">genetic link</a> between <em>E. coli</em> found in fresh ground beef products distributed by Fairbank Farms, an Ashville, New York, meat distributor and the <em>E. coli</em> that sickened people in  Connecticut, Maine, Massachusetts, and  New Hampshire.  <em>E. coli</em> cases in New York may also be linked to this outbreak.</p>
<p>This is a particularly virulent strain of <em>E. coli</em> O157:H7 that has killed 2 people and sent at least 16 people to the hospital.</p>

<p>This outbreak follows another unrelated <em>E.coli</em> outbreak involving more than 20 students and adults from Lincoln Middle School in Lincoln, Rhode Island who became ill with gastrointestinal symptoms after eating ground beef at Camp Bournedale, a nature camp in Plymouth, MA. Ground beef collected at the camp was the same strain of <em>E. coli</em> O157:H7 confirmed in two of the children. In response to the <a href="http://www.pritzkerlaw.com/ecoli/lincoln-middle-school-ecoli.html" target="_self">Lincoln Middle School E. coli outbreak</a>, a <a href="http://www.pritzkerlaw.com/blog/food-poisoning/2009/10/south-shore-meat-company-recall.html" target="_self">ground beef and beef product recall was initiated by South Shore Meats</a> in Brockton, MA last week as a result of the camp related outbreak. The recalled ground beef was distributed in institutional size packages.</p>

<p>To fill an information void left by the meat packer and the USDA&#8217;s <a href="http://www.fsis.usda.gov/">Food Safety and Inspection Service </a>(FSIS), national food safety and food poisoning law firm <a href="http://www.pritzkerlaw.com/food-litigation/">Pritzker Olsen Attorneys</a> is compiling a list of retail grocery chains  involved in the recall. In total, JBS Swift has recalled 421,000 pounds of beef cuts, many of which were used by retailers to make store-packaged ground beef sold on foam trays and wrapped in clear plastic.</p>
<p>Federal health investigators have associated 23 confirmed<a href="http://www.pritzkerlaw.com/ecoli/"> <em>E. coli </em> O157:H7 </a>  with contaminated JBS Swift beef. The outbreak has included at least 12 hospitalizations and at least two patients suffered a severe complication known as <a href="http://www.pritzkerlaw.com/hemolytic-uremic-syndrome/">HUS, or hemolytic uremic syndrome</a>, a type of kidney failure that also attacks a person&#8217;s red blood cells. </p>
